Terms and Conditions

1. Acceptance of Terms

By using embertote.com, placing an order, submitting a contact form, purchasing firewood, or communicating with Ember Tote by phone, text, email, website form, or social media, you agree to these Terms and Conditions.

If you do not agree with these Terms, please do not use this website or place an order.

2. About Ember Tote

Ember Tote provides local firewood delivery in tote-style bags to residential and, where accepted, commercial customers in Raleigh, North Carolina and nearby areas.

Ember Tote is a local delivery service and may be operated as a small startup business. Product availability, delivery times, service areas, and pricing may change at any time.

3. Products and Services

Ember Tote may offer products and services including, but not limited to:

  • Large tote firewood delivery
  • Small tote firewood delivery
  • Recurring firewood delivery packs
  • Promotional firestarter kits or add-ons
  • Local delivery to front doors, driveways, porches, garages, or other customer-approved locations

Product photos, website images, icons, and descriptions are for general illustration only. Actual firewood size, shape, color, bark, moisture content, and appearance may vary because firewood is a natural product.

4. Firewood Quantity and Natural Variation

Firewood sold by Ember Tote is sold by tote, bag, bundle, package, or other clearly stated delivery option, not necessarily by full cord, face cord, or fraction of a cord unless specifically stated in writing.

Because firewood is a natural material:

  • Individual pieces may vary in size and shape.
  • Some bark, dirt, sawdust, insects, or natural debris may be present.
  • Wood may contain cracks, knots, discoloration, or irregular grain.
  • Actual weight may vary depending on wood species, moisture level, weather exposure, and natural density.

Any stated weight, such as “approximately 45 lb,” is an estimate unless expressly stated otherwise.

5. Firewood Type, Seasoning, and Moisture

Ember Tote will make reasonable efforts to describe the firewood being sold, including whether it is seasoned, kiln-dried, mixed hardwood, or another type, when that information is available.

Unless specifically guaranteed in writing, Ember Tote does not guarantee an exact wood species, moisture percentage, burn time, heat output, smoke level, or fireplace/stove performance.

Customers are responsible for determining whether the firewood is suitable for their fireplace, fire pit, wood stove, chiminea, outdoor burner, campsite, or other use.

6. Local Firewood and Pest Awareness

Ember Tote intends to operate as a local firewood delivery business serving the Raleigh-area market. Customers should not transport firewood long distances or across restricted areas without checking applicable rules and pest-control guidance.

Firewood should be stored responsibly and burned within a reasonable period of time. Ember Tote is not responsible for pest issues, insects, mold, or natural organisms that may be associated with stored firewood after delivery.

7. Orders

Orders may be placed through embertote.com, text message, phone, email, social media, or another approved ordering method.

An order is not confirmed until Ember Tote accepts the order and, where required, receives payment or confirms payment instructions.

Ember Tote reserves the right to refuse, cancel, or limit any order for reasons including, but not limited to:

  • Product unavailability
  • Weather or unsafe delivery conditions
  • Delivery address outside the service area
  • Incomplete or inaccurate customer information
  • Suspected fraud or abuse
  • Pricing or website errors
  • Safety concerns at the delivery location
  • Prior non-payment, chargeback, or policy abuse

8. Pricing

Prices are listed on the website or provided directly by Ember Tote. Prices may change at any time without notice.

Unless otherwise stated, prices may not include taxes, special delivery fees, additional-distance fees, stacking fees, special placement fees, or optional add-ons.

If a pricing error appears on the website, Ember Tote may cancel the order or contact the customer to confirm the correct price before delivery.

9. Payment

Payment may be accepted through methods approved by Ember Tote, which may include online checkout, credit/debit card, payment links, cash, or other accepted methods.

Payment is due at the time stated during checkout or order confirmation. Ember Tote may require payment before delivery.

Customers are responsible for providing accurate payment information and ensuring that payments are authorized.

10. Taxes

Sales tax or other applicable taxes may be charged where required by law. Customers are responsible for any taxes, fees, or charges associated with their order unless Ember Tote is required to collect and remit them directly.

11. Delivery Area

Ember Tote’s delivery area may include Raleigh, Cary, Apex, Morrisville, Holly Springs, Fuquay-Varina, Garner, and other nearby areas, depending on availability and scheduling.

Delivery availability is not guaranteed for every address in those cities or towns. Some locations may be outside the delivery area or may require an additional fee.

12. Delivery Timing

Ember Tote may offer same-day, next-day, scheduled, or recurring delivery options, depending on availability.

Any delivery window or estimated delivery time is an estimate, not a guarantee. Delivery may be affected by weather, traffic, vehicle issues, product availability, order volume, daylight, road conditions, or safety concerns.

Ember Tote is not liable for delays outside its reasonable control.

13. Delivery Location and Customer Instructions

Customers are responsible for providing a safe, accurate, and accessible delivery location.

Unless otherwise agreed, firewood may be delivered to a front porch, doorstep, driveway, walkway, garage entrance, side gate, or other accessible location selected by Ember Tote or requested by the customer.

Customer instructions should be provided before delivery. Ember Tote will try to follow reasonable instructions but cannot guarantee exact placement if the location is unsafe, blocked, unclear, inaccessible, wet, muddy, steep, fragile, or otherwise unsuitable.

14. No Entry Into Homes

Unless specifically agreed in advance, Ember Tote does not carry firewood inside homes, living areas, basements, upstairs locations, interior fireplaces, or other interior spaces.

For safety and liability reasons, Ember Tote may refuse any request to enter a home or enclosed interior area.

15. Stacking

Standard delivery does not include stacking unless clearly stated in the product description or separately agreed in writing.

If stacking is offered, it may be subject to an additional fee and may be refused if the stacking area is unsafe, inaccessible, unstable, too far from the delivery point, or otherwise unsuitable.

16. Reusable Tote Bags

Some Ember Tote deliveries may use reusable tote bags. If a reusable tote bag is provided, the customer may be required to leave the empty bag outside for pickup on a future delivery or according to instructions provided by Ember Tote.

Customers should not discard, sell, damage, or use Ember Tote reusable bags for unrelated purposes unless Ember Tote clearly states that the bag is included with the purchase.

Ember Tote may charge a replacement fee for unreturned, lost, or damaged reusable tote bags if this policy is disclosed at the time of purchase.

17. Recurring Delivery Packs

If Ember Tote offers recurring delivery packs, such as four deliveries scheduled every two weeks, the terms of that pack will be described on the product page or order confirmation.

Recurring delivery packs may be prepaid. Unless clearly stated otherwise, “recurring” may refer to a prepaid set of scheduled deliveries and may not automatically renew.

For example, a recurring pack may mean that the customer pays once and receives a stated number of deliveries on a stated schedule. Customers should review the product description before ordering.

If automatic renewal is ever offered, the renewal terms, billing frequency, cancellation process, and customer authorization requirements should be clearly disclosed before purchase.

18. Cancellations and Rescheduling

Customers should contact Ember Tote as soon as possible to cancel or reschedule an order.

Ember Tote may allow cancellations or rescheduling before the order is loaded, dispatched, or delivered. Once an order is out for delivery or has been delivered, cancellation may not be available.

Ember Tote may reschedule delivery due to weather, safety, access issues, product availability, or other operational reasons.

19. Refunds and Returns

Because firewood is a natural and locally delivered product, returns may be limited.

Refunds or replacements may be considered if:

  • The wrong product was delivered.
  • The order was not delivered.
  • The amount delivered was materially different from the order description.
  • The customer reports a serious issue promptly after delivery.

Refunds or replacements may be denied if:

  • The firewood has already been used or moved.
  • The issue is caused by customer storage conditions.
  • The customer provided an incorrect address or unsafe/inaccessible delivery location.
  • The complaint relates to normal natural variation in firewood.
  • The issue is reported too long after delivery.

Customers should report any problem within 24 hours of delivery and include photos if possible.

20. Customer Responsibilities

Customers agree to:

  • Provide accurate contact, delivery, and payment information.
  • Make sure the delivery area is safe and accessible.
  • Keep pets, children, vehicles, and obstacles away from the delivery area.
  • Follow fireplace, fire pit, chimney, stove, HOA, apartment, landlord, local fire code, and safety rules.
  • Store firewood safely and away from structures when appropriate.
  • Use firewood only in a safe and lawful manner.

21. Fire Safety Disclaimer

Firewood can create heat, smoke, sparks, embers, ash, carbon monoxide, and fire hazards.

Customers are solely responsible for safe use of firewood, including proper ventilation, fireplace/chimney maintenance, spark screens, fire pit safety, local burn restrictions, smoke ordinances, and safe disposal of ashes.

Never burn firewood in an unsafe, unvented, prohibited, or inappropriate appliance or location. Never leave a fire unattended.

Ember Tote is not responsible for property damage, injury, smoke damage, chimney problems, appliance problems, fire hazards, burns, carbon monoxide exposure, or other losses caused by customer use, misuse, storage, or handling of firewood after delivery.

22. Allergies, Mold, Insects, and Natural Materials

Firewood is a natural outdoor product. It may contain or attract insects, pollen, mold, mildew, fungus, bark, dirt, sawdust, or other natural materials.

Customers with allergies, asthma, respiratory sensitivities, pest concerns, or indoor air-quality concerns should handle and store firewood carefully and should not store firewood indoors for extended periods.

23. Weather and Outdoor Storage

After delivery, customers are responsible for protecting firewood from rain, ground moisture, flooding, sprinklers, pests, and other outdoor conditions.

Ember Tote is not responsible for moisture, mold, insects, degradation, or reduced burn quality caused by storage conditions after delivery.

24. Promotions, Coupons, and Discounts

Promotions, coupons, firestarter kits, discount cards, door-hanger offers, referral offers, and other specials may be limited by date, location, product, order size, or availability.

Unless otherwise stated:

  • Promotions cannot be combined.
  • Promotions have no cash value.
  • Promotions may be changed or discontinued at any time.
  • “No coupon needed” offers may still require eligibility under the promotion terms.

25. Website Content

Website content is provided for general information and ordering convenience. Ember Tote tries to keep information accurate but does not guarantee that all descriptions, prices, availability, delivery areas, or website content are complete, current, or error-free.

26. Intellectual Property

All Ember Tote names, logos, designs, graphics, icons, text, website content, photos, and branding are owned by or licensed to Ember Tote unless otherwise stated.

You may not copy, reproduce, modify, sell, distribute, or use Ember Tote branding or website content without written permission.

27. Third-Party Services

Ember Tote may use third-party services for website hosting, online payments, order forms, email, text messaging, analytics, maps, scheduling, or advertising.

Ember Tote is not responsible for third-party websites, payment processors, platforms, policies, outages, or security practices.

28. Text Messages and Communications

By placing an order or submitting your phone number, you agree that Ember Tote may contact you by phone call or text message regarding your order, delivery, payment, customer service, bag pickup, scheduling, or related service matters.

Marketing texts, if used, should only be sent in accordance with applicable law and with any required consent. You may ask Ember Tote to stop sending non-essential marketing messages.

29. Limitation of Liability

To the fullest extent allowed by law, Ember Tote is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, loss of use, property damage, or business interruption, arising from use of the website, delivery services, firewood products, or customer handling/use of firewood.

To the fullest extent allowed by law, Ember Tote’s total liability for any claim related to an order is limited to the amount the customer paid for that specific order.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply.

30. No Warranty

Products and services are provided “as is” and “as available,” except where expressly stated otherwise in writing.

Ember Tote disclaims all warranties to the fullest extent allowed by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

31. Indemnification

You agree to defend, indemnify, and hold harmless Ember Tote and its owner, operators, contractors, suppliers, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:

  • Your misuse of the website or services
  • Your unsafe use, storage, or handling of firewood
  • Your violation of these Terms
  • Your violation of law, local rules, HOA rules, lease terms, or fire safety rules
  • Inaccurate information you provide
  • Unsafe or inaccessible delivery conditions at your property

32. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

33. Disputes

Before filing a formal claim, you agree to contact Ember Tote first and make a reasonable good-faith effort to resolve the issue informally.

Any dispute related to Ember Tote, the website, an order, or these Terms shall be handled in the appropriate state or federal courts located in North Carolina, unless another venue is required by law.

34. Changes to These Terms

Ember Tote may update these Terms at any time. The updated version will be posted on embertote.com with a revised “Last Updated” date.

Your continued use of the website or services after changes are posted means you accept the updated Terms.

35. Contact Information

Return and Refund Policy

Because firewood is a natural delivered product, all sales are generally final once the order has been delivered. However, we want every customer to receive what they ordered.


If there is a problem with your delivery, please contact Ember Tote within 24 hours of delivery and include photos when possible.

We may offer a replacement, partial refund, full refund, or store credit if:

  • Your order was not delivered. 
  • Your order was delivered to the wrong address. 
  • You received the wrong product. 
  • The amount delivered was materially different from the product description. 
  • There is a serious issue with the firewood that was not disclosed before purchase. 


Refunds or replacements may be denied if:

  • The firewood has already been burned, moved, mixed with other wood, or stored. 
  • The issue is reported more than 24 hours after delivery. 
  • The problem was caused by rain, moisture, pests, or storage conditions after delivery. 
  • The concern is related to normal natural variation in firewood, including size, shape, bark, sawdust, dirt, cracks, color, or minor debris. 
  • The customer provided an incorrect address or an unsafe/inaccessible delivery location. 


Cancellations are eligible for a full refund only if requested before the order is loaded or dispatched for delivery.

Delivery fees, special handling fees, stacking fees, and add-on services may be non-refundable once the order is out for delivery or completed.
